Navigating the Updated 2024 PAG-02 General Permit

The Pennsylvania Department of Environmental Protection (DEP) has reissued the PAG-02 General Permit for Discharges of Stormwater Associated with Construction Activities. Effective December 8, 2024, this updated permit introduces several important changes and will remain in effect until December 7, 2029.

What’s New in the 2024 PAG-02 General Permit


  1. Affected Landowner Consent: Downstream property owners are now in the position of having to sign off on a project prior to your project completion.   This includes the detailed analysis of site stormwater discharge to waters of the commonwealth. 
  2. New Property Owner Notification Form: Property owners have increased responsibility to transfer the responsibility of maintaining and operating stormwater controls at time of sale.
  3. Confirmation Testing for Infiltration: Post-construction testing required when the infiltration area has not been protect and/or when an E&S BMP will be converted for infiltration purposes. This is testing we are used to completing prior to design. DEP is now requiring it to be completed post-construction to prove it has been installed correctly.
